  1. NAUTILUSCD TERMS AND CONDITIONS

  3. USING ANY NAUTILUSCD DISC INDICATES YOUR ACCEPTANCE OF THE 
  4. TERMS AND CONDITIONS.  
  5.  
  6. RETURN POLICY -- If a NautilusCD disc is found to be damaged or inoperable 
  7. upon receipt, you may return that disc to METATEC Corporation for a 
  8. replacement disc, provided that the damaged or inoperable disc is received by 
  9. METATEC Corporation at 7001 Metatec Boulevard, Dublin, Ohio  43017 within 
  10. 30 days following your receipt of that disc.  This constitutes your sole remedy 
  11. and METATEC Corporation's sole obligation to you with respect to any 
  12. damaged or inoperable discs.
  13.  
  14. NON-RECEIPT / MISSED DELIVERY -- In the event an issue does not arrive, 
  15. replacement issues will be sent at no charge provided the replacement request is 
  16. received within 30 days of the intended delivery date.  Replacement requests 
  17. received past 30 days of the intended delivery date may be subject to a charge.
  18.  
  19. SUBSCRIPTION CANCELLATION / REFUND POLICY -- Subsciriptins may be 
  20. cancelled at any time, for any reason.  Cancellation requests must be received 21 
  21. days prior to the desired date of discontinuance in order to prevent additional 
  22. charges.

  24. Refunds will be issued for any issues not shipped or not in progress.  Issues may 
  25. not be returned for credit.

  27. OWNERSHIP OF MATERIALS AND PROPRIETARY RIGHTS -- NautilusCD 
  28. ROM products are owned by METATEC Corporation and protected by 
  29. copyright law.  The individual programs and products included on the 
  30. NautilusCD disc (the "Material") and all documentation accompanying the 
  31. NautilusCD disc are also protected by copyright law.  Many of the Materials are 
  32. owned by third parties (the "Third Party Authors") who have provided those 
  33. Materials to METATEC Corporation for publication.  METATEC Corporation 
  34. makes no claim of ownership of those Materials and has not verified the 
  35. ownership or accuracy of any of those Materials.
  36.  
  37. You are licensed to use the Material only pursuant to these terms and conditions 
  38. and any additional terms and conditions included on the NautilusCD disc with 
  39. respect to the various Materials.  You may be permitted to copy all or part of 
  40. certain Materials for your use.  However, reproduction of any NautilusCD disc 
  41. in its entirety is prohibited, and you must include the copyright notices on each 
  42. copy of any Material or portion thereof which you make.  You may use the 
  43. NautilusCD disc only on one computer at one time.

  45. ò If a Material is designated as "Free Use", it means that you are granted a non-
  46. exclusive,non-assignable, and non-transferable license to use the 
  47.   Material  free of any additional usage fee or licensing charge for personal, 
  48. business or production use so long as the Material is not used for 
  49.   commercial or resale purposes.  Any commercial use requires permission from 
  50. the author.

  52. ò If a Material is designated as "Demo/Promo", it means that the Material is 
  53. intended for demonstration or review purposes only and is not to be 
  54.   used for any purpose other than evaluation of the Material.
  55.  
  56. ò If a Material is designated as "Shareware", it means that you are entitled to use 
  57. that Material on a trial basis only.  If your use of the Material 
  58.   exceeds the time period set forth in the terms and conditions accompanying the 
  59. Material, you are obligated to forward the indicated Shareware 
  60.   payment to the author of the Material.

  62. Except as otherwise expressly permitted by these terms and conditions or any 
  63. other terms and conditions included on the NautilusCD disc, you may not use, 
  64. sublicense, rent, lease, sell, transfer, disclose, publish, or copy the NautilusCD 
  65. disc, the Materials, or any related documentation.  METATEC Corporation and 
  66. the authors retain all rights and interests not expressly granted to you.

  68. WARRANTY DISCLAIMER AND LIMITATION OF LIABILITY -- SUBJECT TO 
  69. ANY WARRANTY OR DISCLAIMER MADE BY ANY THIRD PARTY 
  70. AUTHOR ON ITS OWN BEHALF, NEITHER METATEC CORPORATION NOR 
  71. ANY LICENSOR NOR ANY THIRD PARTY AUTHOR MAKES ANY 
  72. REPRESENTATIONS OR WARRANTIES, AND EACH HEREBY EXPRESSLY 
  73. DISCLAIMS ALL REPRESENTATIONS AND WARRANTIES, RELATING 
  74. DIRECTLY OR INDIRECTLY TO NAUTILUSCD, THE NAUTILUSCD DISCS, 
  75. THE MATERIALS, OR ANY RELATED DOCUMENTATION, WHETHER 
  76. EXPRESS OR IMPLIED, ORAL OR WRITTEN, OR ARISING BY USAGE OF 
  77. TRADE OR COURSE OF DEALING OR PERFORMANCE, INCLUDING 
  78. WITHOUT LIMITATION ANY WARRANTIES OF ACCURACY, 
  79. PERFORMANCE, MERCHANTABILITY, OR FITNESS FOR A PARTICULAR 
  80. PURPOSE.  EACH USER OF A MATERIAL IS RESPONSIBLE FOR 
  81. DETERMINING THE SUITABILITY OF THAT MATERIAL FOR THAT USER'S 
  82. PURPOSES.  Some jurisdictions do not allow the exclusion of implied 
  83. warranties, so the above exclusion may not apply to you.

  85. IN NO EVENT SHALL METATEC CORPORATION, ITS LICENSORS OR ANY 
  86. THIRD PARTY AUTHOR BE LIABLE FOR ANY INDIRECT, SPECIAL, 
  87. INCIDENTAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, 
  88. INCLUDING WITHOUT LIMITATION LOSS OF DATA, INFORMATION, OR 
  89. PROFITS, EVEN IF INFORMED OF THE POSSIBILITY OF ANY OF SUCH 
  90. DAMAGES, AND WHETHER CLAIMED UNDER CONTRACT, WARRANTY, 
  91. TORT, STRICT LIABILITY, OR ANY OTHER LEGAL THEORY.  Some 
  92. jurisdictions do not allow the limitation or exclusion of incidental or 
  93. consequential damages, so the above limitation or exclusion may not apply to 
  94. you.  The Third Party Authors are not employees or agents of METATEC 
  95. Corporation and have no authority, express or implied, to make any 
  96. representations or warranties or otherwise act on behalf of METATEC 
  97. Corporation.  METATEC Corporation's licensor's liability to you for actual 
  98. damages from any cause whatsoever, and regardless of the form of the action 
  99. (whether in contract, tort (including negligence), product liability or otherwise), 
  100. will be limited to $50.
